This happens in EE, but it possibly is happening in 1.9 too, can you please ask Dean to test?

Edit a piece of content and click on Save and Assign as User 1

The content will have one live and one working version.

Assign to User 2.

Login as User 2 and click on the workflow task and click to Edit the content. Click on Save and Publish, this takes you back to workflow.

From the workflow task again click on the Publish Globe (world icon).

This will publish the working version and leave TWO live versions of the content.

Upon testing, I got an error, but different from the one experienced in EE. I created a linked task 4916 for the related issue in ~~DOTCMS-4916~~ trunk. Closing this task out.
